On-line Consultation Terms and Conditions

Terms and Conditions related to On-line Consultation with Healthcare Professional(s) in the GeneLife 3.0 mobile application.

Proof of identity is required when starting the On-line Consultation for identification purposes. The Customer should ensure to have at least one ID document (*) at hand prior to starting the On-line Consultation.

(*) Japanese driver’s license, a passport or Japanese health insurance card, only.

Definitions:

 Customers:
A customer who has purchased a GeneLife genetic testing kit and accessing the GeneLife 3.0 mobile application to perform an On-line Consultation with a Healthcare Professional.

The On-line Consultation is available to Customers who are 18 years old and older.

If a Customer is a minor, the On-line Consultation will need to be conducted with the Parent or Legal Guardian as per information provided in the Consent Form during the registration.

Genesis Healthcare Co.:
Genesis Healthcare provides a range of genetics testing services through its direct-to-consumer brand GeneLife and through its mobile application GeneLife 3.0.

◆GeneLife genetic testing kits:
GeneLife provides Customers with a range of genetic testing kits, including:

◆GeneLife WGS product and services:
・The GeneLife WGS product and services includes a fifteen (15) minutes On-line Consultation with a Healthcare Professional.

◆Other GeneLife products and services:
・Other GeneLife products and services do NOT include an On-line Consultation with a Healthcare Professional. For details, please refer to “Appendix 1”.
・If a Customer wishes to connect with a Healthcare Professional, an On-line Consultation can be set in the GeneLife 3.0 mobile application and On-line Consultation charges will apply (as listed in the GeneLife 3.0 mobile application when booking an On-line Consultation). For details please refer to “Appendix 2”.

◆GeneLife 3.0 mobile application:
・Genesis Healthcare Co. provides access to its Customers to the GeneLife 3.0 mobile application (and subsequent versions) to review their results and if required perform an On-line Consultation with Healthcare Professional(s).
・The GeneLife 3.0 mobile application supports Apple iOS and Android versions only.
・The GeneLife 3.0 mobile application may be updated from time to time. Customers should update the GeneLife 3.0 mobile application regularly to benefit from the latest versions and updates.
・Costs of smartphone and of internet connections and data charges are directly borne by the Customer.
・The service, including the On-line Consultation session(s) with a Healthcare Professional, through the GeneLife 3.0 Mobile application is not provided for (1) any medical and/or diagnostic purposes, or (2) emergency support and/or aid purposes. Customers seeking such service should contact their own healthcare professional(s) by using other communication methods.

Healthcare Professional(s):
・A qualified Healthcare Professional selected by Genesis Healthcare Co. to provide On-line Consultation to the Customer.
・Prior to the On-line Consultation, an assistant clerk will request you to prove your identity by asking you to present the clerk with an ID document (Japanese driver’s license, a passport, or Japanese health insurance card, only.)
・Only Healthcare Professionals selected by Genesis Healthcare Co. and listed in the GeneLife 3.0 mobile application can provide On-line Consultation and guidance to Customers.
・The list of Healthcare Professionals may change and may be updated at the discretion of Genesis Healthcare Co., at any time and without any notice.
・The Customer should note that the Healthcare Professionals are not specialists in the areas of nutrition, physical activity (e.g., fitness / personal training) and/or beauty (e.g., skin care). As such, the Healthcare Professionals will not be able to provide guidance in these specific topics.
・Healthcare Professional(s) will provide guidance to the Customer based on their own knowledge, medical expertise and judgement.
・The guidance is private, confidential and solely for the purpose of being between the Customer and the Healthcare Professional, pursuant to the laws and regulations of Japan, including medical regulations and guidelines.
・It is the sole responsibility of the Customer to follow or not the guidance provided by the Healthcare Professional.
・Genesis Healthcare Co. has no involvement and no responsibility in any kind in the guidance provided by the Healthcare Professional.
・Neither Genesis Healthcare Co. nor the Healthcare Professionals are not responsible for and have no liability in the outcomes, including but not limited to direct or potential outcomes, resulting from any guidance(s) provided by the Healthcare Professionals during the On-line Consultation session (for further information, refer to the section “DISCLAIMER OF WARRANTIES” and “LIMITATIONS OF LIABILITIES”).

On-line Consultation:
Remote On-line Consultation with a Healthcare Professional is exclusively conducted via the GeneLife 3.0 mobile application (and subsequent versions) and via video conference. No face-to-face consultation is available and provided.
・The Customer will need to download the GeneLife 3.0 app and an internet connection is required to accesConsultation the On-line Consultation with the Healthcare Professional.
・The Customer will need to bear the cost of the internet connection.
・The On-line Consultation is not meant to be used as part of an emergency health enquiry. In case of emergency, the Customer should contact immediately the official health emergency services in their neighbourhood.
・Genesis Healthcare Co., GeneLife and the Healthcare Professionals will not support emergency enquiries and will not bear any responsibilities or any liabilities of any kind if contacted in case of an emergency request.
・Note: The On-line Consultation is provided only for the registered Customer. On-line Consultation is not transferable to any other individual.

1) Appendix 1: On-line Consultation included in the GeneLife WGS product / services

One (1) fifteen-minutes (15-minutes) On-line Consultation with a Healthcare Professional is included in the GeneLife WGS product and services. To avoid any doubt, this On-line Consultation is provided at no charge to the Customer.

The Healthcare Professionals are not specialists in the areas of nutrition, physical activity (e.g., fitness / personal training) and/or beauty (e.g., skin care) and will not provide guidance on these topics.

The Customer agrees to be bound by the following:

◆If a Customer is a minor, the On-line Consultation will need to be conducted with the Parent or Legal Guardian.

◆The On-line Consultation with a Healthcare Professional is limited to 15 minutes only:
・Genesis Healthcare Co., GeneLife and the Healthcare Professional have no obligation to continue the On-line Consultation beyond 15 minutes.
・If you require further On-line Consultation or in case the Healthcare Professional suggests an additional On-line Consultation, a separate On-line Consultation can be set in the GeneLife 3.0 mobile application.
Note that On-line Consultation charges with the Healthcare Professional will apply.
・The cost of the On-line Consultation with a Healthcare Professional will be displayed in the GeneLife 3.0 application at the moment of booking the On-line Consultation appointment.
・Prior to the On-line Consultation, an assistant clerk will request you to prove your identity by asking you to present the clerk with an ID document (Japanese driver’s license, a passport, or Japanese health insurance card, only.)

◆It is important to note that the On-line Consultation is limited to the review of the results of the “Variant Screening” section of the GeneLife WGS product and services:
o Specifically, this includes the “Variant Screening 1” and “Variant Screening 2” reports.
o Note the “Variant Screening” section in the app will be locked until the completion of the On-line Consultation with the Healthcare Professional.
o Other results featured in the GeneLife WGS product and services are not covered by the 15-minute On-line Consultation and the Healthcare Professional will not cover enquiries about these sections.
o To avoid any doubt, the following topics are not covered by the 15-minute On-line Consultation with the Healthcare Professional:
・“Prevention & Wellness” such as “Diseases risks”.
・“Constitution” including “Diet type”, “Sports type” and “Skin type”.
・“Ancestry” such as “Ethnicities”, “Maternal haplogroups” and “Paternal haplogroups”.
・Enquiries related to My Coach

◆The On-line Consultation is exclusively conducted via the GeneLife 3.0 mobile application and only conducted remotely (video conference).

◆Booking of On-line Consultation appointment(s) is exclusively done via the GeneLife 3.0 mobile application.

◆Availabilities (days/time) of healthcare professionals are listed in the GeneLife 3.0 application and are on a “first arrived, first served” basis.
o It is advised to book On-line Consultation ahead of time to secure preferred periods.
o In some periods (such as holidays) limited availability of healthcare professionals may occur.

◆Health history questionnaire:
o When making an appointment to connect with a Healthcare Professional, the Customer will be requested to answer a health history questionnaire prior finalizing the booking.
o The answers to the health history questionnaire by the Customer will provide relevant background information about current condition(s) or family health history to the Healthcare Professional for the On-line Consultation.

◆The Healthcare Professional may suggest further On-line Consultation or medical check with some specialists or medical practitioners.
o The costs related to these additional services are not included in the GeneLife WGS product and services.
o Separate charges will apply and these will need to be borne by the Customer directly. These are not the responsibility of Genesis Healthcare Co. or the Healthcare Professional(s).

◆The On-line Consultation does not include any prescription of any kind. Neither will the Healthcare Professional introduce the Customer to another healthcare or medical professional.

◆Cancellation of On-line Consultation or NO SHOW:
o The Customer can cancel the On-line Consultation in the GeneLife 3.0 mobile application, up to 24 hours prior the On-line Consultation.
o If the Customer cancels the On-line Consultation in less than 24 hours prior the appointment or DO NOT SHOW for the On-line Consultation, it will be the sole decision of the Healthcare Professional to set a new On-line Consultation.
 Certain test results will not be released to the Customer without On-line Consultation with a Healthcare Professional. In order to receive such test results, the Customer has to book and go through an On-line Consultation session. Please note, the On-line Consultation session is not, by any means, a diagnostic session. Genesis Healthcare Co. is not responsible for missed test result disclosures due to the Customer not booking and/or going through an On-line Consultation session.
o In the unlikely case of a cancellation by the Healthcare Professional, the Customer will be notified by the Customer Service of GeneLife and a new appointment will need to be rescheduled by the Customer.

◆Late connection to the On-line Consultation:
o It is the responsibility of the Customer to join the On-line Consultation on time and ensure to access the GeneLife 3.0 mobile application ahead of the appointment time.
o The On-line Consultation is set for fifteen (15) minutes maximum and in case of joining the On-line Consultation late, the On-line Consultation time will be reduced accordingly to the delay.
o In the unlikely case of late connection to the On-line Consultation by the Healthcare Professional, the fifteen (15) minute On-line Consultation time will be maintained in full.

◆Access to the On-line Consultation:
o It is recommended that the Customer connects to the GeneLife 3.0 mobile application at least 5 to 10 minutes prior the On-line Consultation.
o The Customer will need to select the appointment of the On-line Consultation and join in the waiting room until the Healthcare Professional starts the On-line Consultation.

◆Potential technical and connection issues:
o It is advised to have a good quality internet connection to access the remote and video On-line Consultation.
o It is recommended to use wifi connection rather than relying on mobile connection as these are less stable.
o The Customer should ensure to be in a quiet and private area to discuss their results with the Healthcare Professional.
o Using a headset for better quality sound is also highly recommended.

◆If customer never completes the On-line Consultation:
o Certain test results will not be released to the Customer without On-line Consultation with a Healthcare Professional. In order to receive such test results, the Customer has to book and go through an On-line Consultation session. Please note, the On-line Consultation session is not, by any means, a diagnostic session. Genesis Healthcare Co. is not responsible for missed test result disclosures due to the Customer not booking and/or going through an On-line Consultation session.

2) Appendix 2: On-line Consultation with other GeneLife products and services

Other GeneLife products and services do NOT include an On-line Consultation with a Healthcare Professional.

If a Customer wishes to connect with a Healthcare Professional, On-line Consultation can be set in the GeneLife 3.0 mobile application and On-line Consultation charges will apply.

Customer(s) agree to be bound by the following:

◆The On-line Consultation with a Healthcare Professional is limited to fifteen (15) minutes:
o The cost of the On-line Consultation with a Healthcare Professional will be displayed in the GeneLife 3.0 application at the time of booking the On-line Consultation.
o Pre-payment is required through the payment system in the GeneLife 3.0 mobile application and using a credit card.
o The Healthcare Professional has no obligation to continue the On-line Consultation beyond fifteen (15) minutes.

◆The Healthcare Professionals are not specialists in the areas of nutrition, physical activity (e.g., fitness / personal training) and/or beauty (e.g., skin care) and will not provide guidance on these topics.

◆The On-line Consultation is exclusively conducted via the GeneLife 3.0 mobile application and only conducted remotely and through video conference. To avoid any doubts, no face to face On-line Consultation is provided.

◆Booking of appointment is exclusively done via the GeneLife 3.0 application.

◆Availabilities (days/time) of the Healthcare Professionals are listed in the GeneLife 3.0 application and are on a “first arrived, first served” basis.
o It is advised to book an On-line Consultation ahead of time to secure preferred periods.
o In some periods limited availability of healthcare professionals may occur.
o Prior to the On-line Consultation, an assistant clerk will request you to prove your identity by asking you to present the clerk with an ID document (Japanese driver’s license, a passport, or Japanese health insurance card, only.)

◆Health history questionnaire:
o When making an appointment to connect with a Healthcare Professional, the Customer will be requested to answer a health history questionnaire prior finalizing the booking.
o The answers to the health history questionnaire by the Customer will provide relevant background information about current condition(s) or family health history to the Healthcare Professional for the On-line Consultation.

◆The Healthcare Professional may suggest further On-line Consultation or medical check with some specialists or medical practitioners.
o The costs related to these additional services are not included in the GeneLife product and services.
o Separate charges will apply and these will need to be borne by the Customer directly. These are not the responsibility of Genesis Healthcare Co. or the Healthcare Professional(s).

◆The On-line Consultation does not include any prescription of any kind. Neither will the Healthcare Professional introduce the Customer to another healthcare or medical professional.

◆Cancellation of On-line Consultation or NO SHOW:
o The Customer can cancel the On-line Consultation in the GeneLife 3.0 mobile application, up to 24 hours prior the On-line Consultation.
o If the Customer cancels the On-line Consultation in less than 24 hours prior the appointment or DO NOT SHOW for the On-line Consultation, the On-line Consultation will be charged fully and will not be reimbursed. In such a case, the Customer will need to make a new appointment and the subsequent On-line Consultation will be discounted at 50% of its cost.
o In the unlikely case of a cancellation by the Healthcare Professional, the Customer will be notified via the GeneLife 3.0 mobile application and a new appointment will need to be set by the Customer.

◆Late connection to the On-line Consultation:
o It is the responsibility of the Customer to join the On-line Consultation on time and ensure to access the GeneLife 3.0 mobile application ahead of the appointment time.
o The On-line Consultation is set for fifteen (15) minutes maximum and in case of joining the On-line Consultation late, the On-line Consultation time will be reduced accordingly to the delay.
o In the unlikely case of late connection to the On-line Consultation by the Healthcare Professional, the fifteen (15) minutes On-line Consultation time will be maintained in full.

◆Access to the On-line Consultation:
o It is recommended that the Customer connects to the GeneLife 3.0 mobile application at least 5 to 10 minutes prior the On-line Consultation.
o The Customer will need to select the appointment of the On-line Consultation and join in the waiting room until the Healthcare Professional starts the On-line Consultation.

o Payments:
・Payment for the On-line Consultation and other services provided by the Healthcare Professionals is done via the GeneLife 3.0 app.
・Payment is available via Stripe, through credit card only.
・In the case of insurance medical treatment, the Customer will be required to show or provide a digital copy of Health Insurance Card via the GeneLife 3.0 mobile application.
